Has your child been severely injured by the side effects of Topamax? Weitz & Luxenberg can help
CNN shows a baby with blue eyes and rosy cheeks looking curiously at the camera. The child looks healthy except for one thing: he has a cleft palate – a birth defect caused by the side effects of the drug Topamax (CNN). The FDA has not yet taken the drug off the market, but they have issued a warning for pregnant women.
A cleft palate often requires several surgeries to fix, and may even require a prosthetic device (PubMed 1).
Weitz & Luxenberg feels that no mother should have to go through the experience of having a child with a birth defect. We believe that no drug should have a risk of birth defects as a possible side-effect. We offer our sincere condolences to the mothers who have given birth to children with cleft palates because they took the drug Topamax while pregnant without any warning of such side effects. We would also like to help you pursue legal action in order to receive financial compensation for your child’s injury. The compensation we can help you receive can go towards continuous care for your child’s cleft palate, and make sure he or she has the funds available to cover any issues the cleft palate my cause in the present or future.

The FDA takes action
In March of 2011, the FDA placed the drug Topamax (Topiramate) in Pregnancy Category D – meaning that there is now “positive evidence of human fetal risk based on human data” (PubMed 2). If a pregnant woman takes Topamax, her child has a 1.4% increased risk of developing a deformed mouth. The normal risk of a mouth defect of this kind is .07%.
"Health care professionals should carefully consider the benefits and risks of topiramate when prescribing it to women of child-bearing age…alternative medications that have a lower risk of birth defects should be considered,” said the director of the FDA's division of neurology products, Dr. Russell Katz (USAToday).
The off-label uses of Topamax
Topamax is a drug used to treat epilepsy and migraines, but many doctors have been prescribing it for off-label conditions such as alcoholism and mental disorders.
Finding financial compensation
Weitz & Luxenberg has a long history of successful verdicts and settlements especially when it comes to defective medications. We helped individuals who had, at times fatal, heart attacks caused by Vioxx, which has since been taken off the market due to its severe side effects. In one landmark case, we were able to help John McDarby, a man who suffered a heart attack because of the drug and broke his hip in the process, receive $13.5 million in compensation. We can help you and your child as well.
