FALSE CLAIMS ACT – U.S. v. Kellogg Brown & Root Servs. Inc.

OPINION – Kellogg Brown & Root Services Inc. cannot respond to a lawsuit alleging it overbilled the government for private security in Iraq with claims that the government failed to protect its contractors adequately because it did not exhaust its administrative remedies, a federal judge has ruled. ADA – Colo. Cross-Disability Coal. v. Abercrombie & Fitch Co.

ORDER – Class certification is granted to wheelchair users who are suing Abercrombie & Fitch for making their Hollister Co. stores inaccessible to wheelchairs. Many of the stores feature elevated, porch-like entrances that cannot be accessed with a wheelchair. (D. Colo.)

ADMINISTRATIVE LAW – Mylan Pharm. Inc. v. Sebelius

OPINION – Under the Drug Price Competition and Patent Term Restoration Act of 1984, the FDA gave Teva a 180-day marketplace exclusivity period for the generic version of the drug Provigil, even though Teva also held the original patent. Even though this was against the public interest and the intent of the Act, the FDA applied the Act correctly. (D. D.C.)

ENVIRONMENTAL LAW – Center for Biological Diversity v. Jackson

COMPLAINT – The Environmental Protection Agency the U.S. Coast Guard has authorized the excessive use of chemical dispersants to deal with oil spills without taking the necessary steps to ensure the protection of wildlife and the environment, conservation groups allege in a lawsuit. (N.D. Cal.)
