Temporary art installation, most likely protected by copyright in Germany (where this work was located), see also German Wikipedia's article on "Wrapped Reichstag" as a similar case. I think that Commons can't host these files per Commons:Licensing (must be free in the U.S. and in the source country of the work) and COM:PRP (although I'm not 100% sure that this is actually copyrightable art in Germany, "Wrapped Reichstag" is known to be copyrighted, and this is a similar kind of "temporary sculpture" by Christo). Even if the work were located outdoors (not the case), freedom of panorama wouldn't be applicable as per the German Federal Court of Justice's Wrapped Reichstag decision (no FoP for temporary art installations).

Ich halte das BGH-Urteil nach wie vor für einen Justizirrtum, da der Aspekt "bleibend" falsch beurteilt wurde (Eisskulpturen usw...), es ist aber ein höchstrichterliches Urteil, was für uns bindend ist. Kann man blöd finden, ist aber so. --Ralf Roleček 22:54, 7 July 2016 (UTC)[reply]
Ja, genau. Macht mir auch keinen Spass, so einen Löschantrag zu stellen! Aber wir müssen auch unsere Nutzer und Weiternutzer vor möglichen rechtlichen Problemen schützen. Hier kommt noch dazu, dass Panoramafreiheit ja nicht mal anwendbar wäre, wenn sie beim Verhüllten Reichstag bejaht worden wäre, da "Big Air Package" sich in einem Innenraum befand. Zitatrecht wäre abgedeckt aber das wird hier ja nicht geduldet. Also bleibt BGH, bis vielleicht irgendwann eventuell EuGH was anderes entscheidet. Blöd, aber nicht zu ändern. Wenigstens ist die belgische Entscheidung zur panoramafreiheit ein Lichtblick, vielleicht tut sich ja irgendwann was.
