Abstract

In its dynamic processuality, migration represents the quantitative movements of the populations and people through emigration (exit from a country of origin) and immigration (entry into a country of destination) where the migrants have the main aim to identify a conducive environment to employment, health, education, human respect and welfare. From this background of the correlative terms, the concept of "immigration" is the most complex in form and content, because it involves for a designated geographic area (country, region, continent) the exceptional government and international interventions in the management, administration, governance, resources supply, medical care, legal assistance, etc., depending on the number of people arrived in the host country. This article focuses on the concept of "immigration" in order to determine its scientific meanings and legal interpretations through the European legal system in close correlation to the subject of the International law.But why and how the phenomenon of immigration is legal controlled in Europe? To answer this question, we can consider the following hypotheses: immigration is a major challenge complex contemporary world, a reality intensively studied by the specialised literature; European Union law contains principles, procedures and methods available to improve the European legal system in the effectively managing migration phenomenon; Romania offers the humanitarian and legal responses to the flow of immigrants in the European territory.
