How to Divorce

Step One:

Determine if you qualify for a summary divorce.

Step Two:

If you do not qualify for a summary divorce but agree with your spouse on all issues, follow the steps for an uncontested divorce.

Step Three:

If you are unable to come to an agreement, contact an attorney.

Domestic Partners

Domestic partners use a few different CA family law forms in a dissolution (divorce).   The main forms that differ are the Petition – Domestic Partnership, FL-103; and Response – Domestic Partnership, FL-123.

California Residency is not required if the partnership is registered in California or at least one partner is living in CA.

Other laws generally mirror those that are applied to married persons.
