§ 1 Scope

The business relationship between Breitkopf & Härtel KG publishers, Walkmühlstraße 52, 65195 Wiesbaden, Germany (“Seller”) and the customer is subject to the following general terms and conditions.

§ 2 Entry into the contract

Your order will be initiated by clicking on “Order with obligation to pay” in the shopping cart. By placing the order you make a binding commitment to purchase the goods. You will immediately receive an e-mail to confirm that your order has been received. The confirmation of receipt is generated automatically; it does not yet confirm acceptance of the order. The purchase contract is constituted when we ship the ordered goods to you and confirm shipment in a second e-mail (shipping confirmation).

§ 3 Right to cancel

Consumers have a statutory right to cancel. A consumer is any natural person who enters into a transaction for a purpose that can be attributed neither to their commercial nor to their independent professional activities (section 13 of the Bürgerliches Gesetzbuch (German Civil Code – BGB)).
The right to cancel does not apply to distance and off-premises contracts in the case of a contract for the supply of sealed audio or sealed video recordings or sealed computer software, if the goods become unsealed after delivery.

§ 4 Goods subject to non-availability

We reserve the right not to execute your order, if the ordered title is not in stock, the out-of-stock title is out of print, and the goods ordered are therefore not available. In this case, we will inform you immediately that the goods are not available and immediately refund any purchase price you have already paid.

§ 5 Shipping costs

We charge flat shipping rates depending on the delivery area. Here you can find the shipping costs overview.

§ 6 Return shipping costs

If you cancel (§ 3), you have to bear the regular costs of return shipment, if the goods delivered correspond to the goods ordered.

§ 7 Terms of payment and delivery

Unless agreed otherwise, deliveries will be made ex stock from Breitkopf & Härtel to the delivery address specified by the customer. Unless arranged otherwise, the purchase price will become due when the contract is constituted. The purchase price can be paid by credit card or PayPal. The goods will normally be dispatched within 2 working days, if they are in stock.

§ 8 Reservation of title

The goods shipped remain the property of the Seller until the purchase price receivable has been settled in full by the customer.

§ 9 Warranty

If the goods are defective, the legal provisions of sections 434 et seq. of the BGB apply.

§ 10 Data protection

We will use your personal data exclusively for purposes relating to your order, e.g. information on your order status and/or delivery status and for internal customer analysis. Personal data will be treated confidentially as a matter of course. Please also see our data protection declaration under Privacy and security. The customer expressly agrees to the collection, processing, and use of the data received in connection with the business relationship. The customer has a right to information as well as a right to having their data corrected, blocked, and deleted.

§ 11 Applicable law and jurisdiction

Contracts are subject to the laws of the Federal Republic of Germany to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the customer is a merchant or a legal person under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the court responsible for our registered office at Wiesbaden.
