Bundaberg Regional Council Planning Scheme

The Bundaberg Regional Council Planning Scheme 2015 and supporting Planning Scheme Policies (the planning scheme) were adopted by Council at its meeting held 13 October 2015.

The planning scheme was gazetted on 16 October 2015 and commenced on Monday, 19 October 2015.

The planning scheme sets out the blueprint for future growth and development of the Bundaberg Region. It was originally made under the Sustainable Planning Act 2009 but was amended in July 2017 to align with the new Planning Act 2016.

Council, at its Ordinary Meeting held 24 April 2018, adopted an amendment to its planning scheme to include its new Local Government Infrastructure Plan (LGIP). This LGIP amendment (i.e. Planning Scheme [version 4.0]) was gazetted on 4 May 2018 and commenced on 7 May 2018. The LGIP replaces the Priority Infrastructure Plan (PIP) previously contained in the planning scheme. To support the LGIP amendment associated changes have been made to the planning scheme and planning scheme policy for development works. Amenity and Aesthetics and Building Work involving Removal or Rebuilding Policy


On the 31 October 2017, Council adopted a new Amenity and Aesthetics, and Building Work Involving Removal or Rebuilding Policy that applies to particular building work. This policy affects building work involving particular Class 1a (dwelling houses) and Class 10 buildings and structures (e.g. domestic sheds and carports) by including requirements that seek to limit the potential for adverse impacts from such development on the amenity and character of the surrounding area.

Temporary Local Planning Instrument 1/2018 – Protection of the Mon Repos Turtle Conservation Area


In late 2016 the Planning Minister at the time, Hon. Jackie Trad MP, raised concerns with Council that its Planning Scheme did not sufficiently protect the Mon Repos turtle rookery from the adverse impacts of development.  In March 2017, Council adopted a temporary local planning instrument to provide an interim response to these concerns, pending amendments to Council’s Planning Scheme.   TLPI 1/2017 took effect on 17 March 2017 and ceases to have effect on 16 March 2018.  While Council continues to work on amendments to its planning scheme, it was considered necessary to prepare a new TLPI to ensure Council’s planning instruments continue to address concerns over potential impacts of development on the Mon Repos turtle rookery. 

Council resolved at its meeting held 27 February 2018  to adopt Temporary Local Planning Instrument 1/2018 – Protection of the Mon Repos Turtle Conservation Area (see notice of adoption).  The new TLPI is essentially identical to TLPI 1/2017.  The TLPI suspends aspects of Council’s Planning Scheme and applies to land on the seaward side of Shelley Street, Burnett Heads, from Dryden Street south to and including 174 Shelley Street (as identified in mapping included in the TLPI).  TLPI 1/2018 takes effect on 16 March 2018 and will cease to have effect on 16 March 2020 unless repealed earlier.

Temporary Local Planning Instrument 2/2017 – Cordalba to Wallaville Cane Railway Infrastructure


Temporary Local Planning Instrument (TLPI) 2/2017 has been adopted by Council to provide an interim policy response to facilitate the development of new cane railway infrastructure from Cordalba to Booyal and Wallaville. The TLPI responds to a significant risk of serious adverse economic, social or cultural conditions in the Bundaberg Region. Specifically, the potentially lengthy timeframes and uncertainty associated with the impact assessment or planning scheme amendment process presented a risk that this regionally significant infrastructure project would be significantly delayed, or in the worst case scenario, abandoned. To address these concerns and provide certainty for residents with regard to the proposed railway alignment, Council at its meeting held 19 September 2017 adopted a temporary local planning instrument (TLPI) (see notice of adoption). Temporary Local Planning Instrument 2/2017 – Cordalba to Wallaville Cane Railway Infrastructure provides an interim policy response that suspends aspects of Council’s Planning Scheme; the TLPI took effect on 25 September 2017 and will cease to have effect on 24 September 2018 unless repealed earlier.

Charges Resolution (No. 1) 2018
Council, at its Ordinary Meeting held 24 April, 2018, adopted Charges Resolution (No. 1) 2018 for the purposes of setting infrastructure charges under the Planning Act 2016. With the amendment of Council’s Planning Scheme to include a Local Government Infrastructure Plan (LGIP), it was necessary for Council to update its charges resolution to align and comply with the Planning Act 2016, especially to remove references to the Priority Infrastructure Plan (PIP) and replace them with references to the new LGIP.  Council’s previous Adopted Infrastructure Charges Resolution (no. 1) 2015 achieved a good balance between affordability and sustainability in terms of infrastructure charges. Therefore this new charges resolution remains largely unchanged from the previous resolution.  In particular, it is noted that the charging areas, discounts and charging rates in this new resolution remain unchanged from the previous charges resolution.

Superseded Planning Schemes


The Bundaberg Regional Council Planning Scheme 2015 (version 3.0) and associated Planning Scheme Policies replaces the previous version of the planning scheme and associate planning scheme policies. The new planning scheme does not affect existing lawful uses or current development approvals. For a period of 12 months from a planning scheme being made superseded, a person may request Council assess a proposed development under the provisions of the relevant superseded planning scheme.
