Mobile trading

The Mobile Trading and Temporary Stall Bylaw was adopted in 2014 and will be revoked from 1 January 2021

Restrictions

Unless permission has been granted by the appropriate DCC departments, holders of mobile trading permit may not trade in the following areas.

  • George Street from the Octagon to Albany Street
  • Princes Street from the Octagon to Jetty Street
  • Lower Stuart Street from the Octagon to Moray Place
  • Moray Place
  • The Octagon, except for restricted specified sites.
  • Wickliffe Square, except for restricted specified sites.
  • Museum Reserve, except for restricted specified sites.
  • Any area where it is not permitted to stop a vehicle under the Land Transport (Road User) Rule 2004 or the Traffic and Parking Bylaw.
  • Parks or reserves which require appropriate permission under the Reserves Act 1977.

Getting a mobile trading permit

Discuss your proposal for a mobile trading permit with Environmental Health staff beforehand to ensure you understand any regulations and conditions, particularly if you wish to sell food.

Before you can trade you will need to apply for and obtain a mobile trading permit. If you intend to sell food you will also need to obtain a certificate of registration under the Food Act 2014.

Touting permit

The Trading in Public Places Bylaw requires a permit to carry out touting.

Touting includes, for example, tour operators soliciting business in public places. It also includes hawking and peddling.

Mobile trading leased sites

There are sites available for registered mobile traders to lease at the Exchange (Wickliffe Square), the Octagon and the Museum Reserve. For more information about these sites, please contact us.

Mobile trading leased sites at Wickliffe Square and the Octagon can be booked using the online booking system.

There are two sites available at each location and through the new system, you can book any these sites online.

To book a mobile trading leased site, you will first need to have or apply for a mobile trading permit and you can then register online to create an account (see user guide below).

Please email transport@dcc.govt.nz if you no longer require your online account.

Selling food as a mobile trader

If you are interested in selling food outdoors, you need to know there are food safety requirements around operating a food truck, a food stall, and at fundraising events where food is created and sold. If you are selling food, it must be prepared either in the mobile vehicle or from a base kitchen. Alongside your mobile trading licence, the food business must also be registered under the Food Act 2014.

Temporary food stalls

Application forms for a temporary food stall are available from the Council website, or from Environmental Health or the Customer Services Agencies. You may wish to discuss your proposal with Environmental Health staff beforehand, to ensure you are fully aware of your responsibilities in terms of selling safe food.
