    Variation 2 to the 2GP - appeals

    27 March 2023

    On 8 February 2023 the second decision on Variation 2 was released and appeals closed on 21 March 2023. The 2GP was updated to remove the notification mark-up and add highlighting to those provisions under appeal.

    Variation 2 is a change to the 2GP which includes a suite of changes to enable additional housing capacity through specific rule and policy changes and through rezoning specific sites.

    On 8 February 2023 the second decision on Variation 2 was released, which covered the matters considered at Hearing 4. Hearing 4 primarily considered submissions on the proposed greenfield rezoning sites that were notified in Variation 2 and submissions on sites that were subject to a preliminary assessment in the plan evaluation report (s32 report), but rejected for various reasons, which were also open for submissions.

    Variation 2 to the 2GP notified

    On 3 February 2021 Variation 2 - Additional Housing Capacity, to the proposed 2GP was notified for public submissions. Clause 16A of Schedule 1 of the Resource Management Act allows a local authority to initiate a variation to a plan at any time before the approval of the plan. A report has been prepared by DCC officers outlining the proposed amendments, incorporating a summary of the evaluation required under section 32 of the RMA.     2GP update: Partial removal of minimum car parking provisions

    3 February 2021

    On 3 February 2020, the 2GP was updated to remove the minimum car parking performance standard for standard residential activity in the residential zones.  These changes were made in accordance with the National Policy Statement on Urban Development 2020.  A summary of the updates made is available.

    2GP Appeals version – Variation 1 deemed operative provisions, minor amendments and partial resolution of the ORC appeal

    This version of the Plan:

    • incorporates the Variation 1 changes that did not receive submissions in opposition and therefore are deemed operative;
    • incorporates minor amendments pursuant to Clause 16(2) of Schedule 1 of the RMA (Batch 5 – 22 May 2020); and
    • updates provisions in accordance with the Consent Order for ORC appeal point 63 (Earthworks Rules) dated 21 May 2020.

    End of initial submission period on Variation 1

    22 January 2020

    On 18 December 2019 the initial submission period for Variation 1 – Minor Amendments to the proposed 2GP ended. 2GP provisions and mapping changes which did not receive any submissions are now deemed operative, and the 2GP and 2GP Planning Map have been updated accordingly.  The further submission period is intended to commence on Wednesday 29th January and close on Thursday 13th February.

    The 2GP Planning Map has also been updated with the proposed amendments to zoning and mapped areas shown as a new layer.

    On 26th September 2019 the 2GP was updated to include Batch 3 of minor amendments. Clause 16(2) of Schedule 1 of the Resource Management Act allows a local authority to make an amendment to the 2GP where the alteration "is of minor effect, or may correct any minor errors", without needing to go through the submission and hearing process. A report has been prepared by DCC officers that outlines the amendments made to the 2GP.

    The 2GP Planning Map has also been updated with Batch 3 cl.16 changes and designation updates.

    2GP update: Batch 2 of cl.16 minor amendments

    On 12 February, the 2GP was updated to show all provisions under appeal. Provisions that are directly subject to, or likely to be consequentially affected by, an appeal have been highlighted red. In addition to the highlighting, the 2GP was updated to include Batch 2 of minor amendments. Clause 16(2) of Schedule 1 of the Resource Management Act allows a local authority to make an amendment to the 2GP where the alteration “is of minor effect, or may correct any minor errors”, without needing to go through the submission and hearing process. A report has been prepared by DCC officers that outlines the amendments made to the 2GP.

    The 2GP maps have been updated to include an ‘appeals layer’. This layer shows what sites and mapping elements have been appealed.

    Update on appeals

    17 January 2019

    The period for lodging an appeal closed on the 19 December 2018. 83 appeal notices were lodged on the 2GP and these can be viewed at https://www.dunedin.govt.nz/council/district-plan/2nd-generation-district-plan/appeals-received-on-the-2gp. Planning staff are identifying the provisions that are now ‘under appeal’ and an appeals version of the 2GP will be released as soon as possible. This version will be available electronically on the website and will highlight which rules are under appeal, and which can be deemed operative (as not subject to appeal). The plan will be updated through the appeal process as appeals are withdrawn or resolved.

    A public notice was published in the Otago Daily Times on 6 October 2018 notifying that on 2 October 2018 Council rescinded their decision to defer the type of the of rules provided for in S86B(3) from having immediate legal effect.     2GP update: Batch 1 of cl.16 minor amendments

    Decisions on the 2GP notified

    7 November 2018

    Decisions on the 2GP were notified on the 7 November 2018. Submitters were notified by post and email which included a letter, a memorandum from the 2GP Hearings Chairperson and a copy of the  public notice. The public notice was also published in the Otago Daily Times on 7 November 2018. The decisions on the 2GP are now open to appeal. It is anticipated that the initial appeal period will conclude on or about 20 December 2018.

    Waiver from Environment Court for s274 parties to not give notice

    19 October 2018

    Usually a s274 party would have to serve all other s274 parties to an appeal. However, for the 2GP, the DCC has been granted a waiver from the Environment Court so that only the DCC, the Environment Court and the appellant parties need to be served with a s274 notice. This means that other submitters do not need to be served because the DCC will place all s274 notices on this webpage of the 2GP website.
